What is legal separation?

Legal separation deals with all practical elements of divorce: division of marital property, possession of the family home, child custody, visitation, and child and spousal support. The agreement does not cover those elements in the event of the death of one spouse. For that reason our attorneys may suggest that the legal separation later be redrafted as a petition for divorce.

Legal separation for new California residents

California requires a person filing for divorce to have been a resident of the state for six months. If you have recently moved to the state you can, however, immediately file for legal separation.
